Blue Public — End-User Licence Agreement

This End-User Licence Agreement ("EULA") is a binding contract between you ("you", "user") and the Blue Public project ("we", "us"). By installing, running, or otherwise using the Blue Public client software ("the Software") you accept this EULA in full. If you do not accept it, do not install or use the Software.

This document is plain English on purpose. It is not a substitute for legal advice. You are responsible for confirming your own jurisdiction's rules before installing, purchasing, or otherwise dealing with the Software.

1. What you are getting

Blue Public is an unofficial third-party client for Minecraft Java Edition 1.8.9. It is distributed as a compiled binary. Source code for the client is not included with this binary release and is not licensed under any open-source licence — all rights are reserved.

Subject to this EULA, we grant you a non-exclusive, non-transferable, revocable, personal-use licence to run the Software on hardware you own or lawfully control, for the duration of the access tier you currently hold (see section 3).

2. What you must already have

You may only use the Software in conjunction with a legitimately purchased Minecraft Java Edition account. Your account must be authenticated through Microsoft. The Software deliberately refuses to connect to multiplayer servers without a valid Microsoft access token — there is no "cracked" or "offline" multiplayer path.

3. Access tiers

Blue Public is currently in a closed beta. Access to the closed beta requires you to hold one of the following tiers:

3.1 Free Beta Access (lottery)

We periodically run lotteries that grant Free Beta Access to a limited number of participants. Free Beta Access:

  • is granted at our sole discretion, on whatever terms we announce for that particular lottery;
  • carries no purchase price;
  • is valid until public release of the Software, after which the closed beta ends and Free Beta Access tier no longer exists;
  • may be revoked at any time, for any reason, without notice or refund.

We do not guarantee that any given lottery participant will win, that lotteries will continue at any particular cadence, or that lotteries will run at all.

3.2 Lifetime Beta Access ($5 USD)

Lifetime Beta Access is a one-time purchase that grants closed-beta access for the entire duration of the closed beta, without re-application. It costs $5 USD (or the local-currency equivalent set by the storefront, plus any taxes the storefront collects).

After full public release, Lifetime Beta Access entitles you to continue using any Lifetime-only perks we choose to maintain (for example, a "founder" cosmetic flag). We do not promise specific post-public-release perks; we promise only that we will not retroactively downgrade Lifetime Beta Access to a lower-tier entitlement.

Lifetime Beta Access is sold through the third-party storefront Ko-fi (operated by Ko-Fi Labs Limited, UK). The storefront handles the actual payment; we do not see your card number, and your billing relationship is with them. 3.3 Cosmetic items (future)

We may sell cosmetic items (capes, particles, in-game flair). Each cosmetic is a separate, non-refundable digital purchase that does not extend or modify your access tier. Cosmetics are described separately at the time of purchase.

3.4 Subscriptions (future)

We may add subscription tiers (recurring monthly or yearly fees) for additional features. If we do, the subscription terms will be presented for your acceptance at the time of subscription, and the version stamp at the top of this document will be incremented to re-prompt all users.

4. Refund policy

4.1 Lifetime Beta Access ($5)

Lifetime Beta Access is a digital good and is non-refundable except as required by applicable law, with one specific carve-out: if a documented technical defect of the Software prevents you from launching it on supported hardware (Windows 10/11 or Linux x86_64), and we have not fixed the defect within 7 days of you reporting it through the channels in section 13, we will refund the purchase on request.

4.2 Cosmetics

Cosmetics are non-refundable. Once granted, they remain on your account for the duration this EULA is in force.

4.3 Subscriptions (when launched)

We will publish the subscription refund policy at subscription launch. We will not default to "no refunds" — at minimum we will honour the cooling-off period required by Japanese consumer law for online subscriptions.

5. Termination

5.1 By you

You may stop using the Software at any time. For Lifetime Beta Access, ceasing to use the Software does not entitle you to a refund. For Free Beta Access, no refund exists by definition.

5.2 By us

We may revoke your access — across any tier — if you breach this EULA, in which case no refund is owed. We may also revoke access for operational reasons (for example, sunset of a server we operate). If we revoke a paid tier for operational reasons, we will offer a pro-rata refund or migration path; if we revoke a paid tier for a breach by you, we will not.

Sections 6 (restrictions), 7 (Mojang content), 9 (no warranty), 10 (liability), 14 (governing law) survive termination of this EULA.

6. Things you must not do

You agree not to:

  1. Reverse-engineer, decompile, or disassemble the Software except to the extent that this restriction is unenforceable under applicable law.
  2. Bypass, disable, or tamper with the licence check, integrity check, or any other protection mechanism in the Software.
  3. Redistribute the Software, in whole or in part, in original or modified form, to anyone — including by mirror, repackaging, hosting it for others to download, or sharing your licence token, lottery win, Lifetime Beta Access entitlement, cosmetic, or Discord beta role.
  4. Use the Software to violate the rules of any Minecraft server you connect to, any law that applies to you, or Mojang's end-user licence agreement for Minecraft.
  5. Use the Software to harass, dox, threaten, or harm any person.
  6. Resell, sublicense, lend, or transfer any access tier or cosmetic for commercial benefit. Access tiers are personal and non-transferable.
  7. Charge back a purchase that you genuinely received without first asking us for a refund through the channels in section 13. A chargeback without prior contact is treated as a breach and results in immediate revocation of all tiers and cosmetics linked to the account, with no refund.

Violation of any of the above terminates your licence immediately and permanently, without notice.

7. Mojang content

The Software is not affiliated with, endorsed by, or sponsored by Mojang Studios, Microsoft, or any related entity. The Software does not contain Mojang's textures, sounds, models, or copyrighted code. It loads those assets from your own legally obtained Minecraft installation when you run it.

You are responsible for compliance with Mojang's terms in your use of those assets.

8. Updates and changes

The Software contains an auto-updater. By using the Software, you authorise us to deliver software updates over the network. Updates may include security fixes, feature changes, removal of features, or termination of the beta. Refusing updates may permanently break your client.

We may change this EULA. Material changes are signalled by bumping the version stamp at the top of this document; the Software will re-prompt you to accept the new version before continuing. Continued use after acceptance constitutes consent to the new terms. If you do not accept new terms, your only remedy is to stop using the Software, and (for Lifetime Beta Access bought less than 14 days before the material change) to request a refund under section 4.1.

9. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPATIBLE WITH YOUR HARDWARE, OR THAT IT WILL NOT GET YOU BANNED FROM ANY SERVER OR REVOKED FROM ANY ACCOUNT YOU CHOOSE TO USE WITH IT.

10. Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, ACCOUNT BANS, IN-GAME ITEM LOSS, OR ANY OTHER LOSS ARISING FROM YOUR USE OF THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER OR IN CONNECTION WITH THIS EULA IS LIMITED TO THE AMOUNT YOU HAVE ACTUALLY PAID US (OR ON OUR BEHALF, TO THE STOREFRONT THAT SOLD YOU THE TIER OR COSMETIC) IN THE TWELVE MONTHS PRECEDING THE CLAIM. FOR FREE BETA ACCESS THIS AMOUNT IS ZERO. FOR LIFETIME BETA ACCESS THIS AMOUNT IS THE PURCHASE PRICE YOU PAID. NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE LIMITED BY APPLICABLE LAW.

11. Data

We collect a limited set of operational data described in our Privacy Policy. By using the Software you also accept that document.

12. Children

The Software is not directed at children under 13. If you are under 13, do not install or use the Software, and do not purchase Lifetime Beta Access or any cosmetic.

13. Contact, refund and breach reports

Questions, breach reports, refund requests, and tier-revocation requests: the project's Discord server. For paid-tier or cosmetic refund requests, include the storefront order ID.

14. Governing law

This EULA is governed by the laws of Japan, excluding its conflict-of-laws rules. Any dispute arising under this EULA is subject to the exclusive jurisdiction of the courts of Tokyo, Japan.

Acceptance of this EULA is recorded locally at <config-dir>/bluepublic/state.json. You may revoke acceptance at any time by deleting that file and uninstalling the Software. Revoking acceptance does not refund any paid tier; refund requests follow section 4.
